Our debt collections process

Pre-Legal Phase ( soft collections) : This is the initial, non-legal stage of collecting a debt, aimed at encouraging voluntary payment.

Goal: Recover debt without legal action while preserving the relationship and reducing costs.
Key Steps:

1. Full financial trace and investigations to determine liquidity
2. Communications through calls, SMS, & emails Reminder Calls & Emails – Friendly follow-ups to remind the debtor of outstanding payments.
3. Letter of Demand – A formal letter requesting payment within a specific time (typically 10–20 business days).
4. Negotiation / Payment Arrangements – Debtors may negotiate repayment plans or settle the debt.
5. Acknowledgment of Debt (AOD) – A signed agreement where the debtor agrees to repay the debt in instalments.

Litigations phase (Hard Collections) If soft collection efforts fail, the creditor may proceed with legal action to enforce payment.
Goal: Legally enforced debt recovery through the courts and asset seizure or salary garnishing.

Key Steps:
1. Summons Issued – Legal notice sent via the court, giving the debtor 10 days to respond.
2. Default Judgment – If no response is filed, the court may grant judgment in the creditor’s favour
3. Court Hearing – If the debtor defends the claim, the matter proceeds to trial.
4. Enforcement Actions:
◦ Warrant of Execution – Sheriff seizes property to sell and recover the debt.
◦ Emoluments Attachment Order (EAO) – Salary deductions made via the debtor’s employer.
◦ Garnishee Order – Funds deducted from bank accounts.
